Acceptable Use Policy

1. Purpose
This Acceptable Use Policy ("AUP") outlines the permitted and prohibited uses of NexTunnel's VPN service ("Service"). By using the Service, you agree to comply with this policy. This AUP is incorporated into and supplements our Terms of Service.
2. Permitted Uses
The Service is intended for lawful privacy and security enhancement, including:
- Protecting your privacy and securing your internet connection
- Accessing geo-restricted content for personal, non-commercial use
- Securing connections on public or untrusted Wi-Fi networks
- General web browsing, streaming, and communication
- Remote work and secure access to corporate resources
- Protecting sensitive communications (journalism, activism, research)
- Bypassing censorship in restrictive network environments
3. Prohibited Uses
You may NOT use NexTunnel for any of the following activities. Violations may result in immediate account termination without refund and potential referral to law enforcement:
3.1 Criminal Activities
- Any activity that violates applicable local, national, or international laws
- Distribution, storage, or access of child sexual abuse material (CSAM)
- Terrorism-related activities (recruitment, funding, planning, propaganda)
- Human trafficking, exploitation, or modern slavery
- Drug trafficking or sale of illegal substances
- Money laundering or financial fraud
- Sale of weapons, explosives, or other prohibited items
3.2 Cybersecurity Offenses
- Unauthorized access to computer systems, networks, or data (hacking)
- Distribution of malware, ransomware, viruses, or trojans
- Distributed Denial of Service (DDoS) attacks
- Participation in or control of botnets
- Exploitation of software vulnerabilities without authorization
- Port scanning, network probing, or vulnerability scanning of systems you do not own
- Credential stuffing, brute-force attacks, or password spraying
3.3 Fraud & Abuse
- Phishing, spear-phishing, or social engineering attacks
- Identity theft or impersonation
- Click fraud or advertising fraud
- Credit card fraud or unauthorized financial transactions
- Creating fake accounts on third-party services
3.4 Content-Related Violations
- Sending spam or unsolicited bulk communications
- Harassment, threats, stalking, doxxing, or intimidation
- Distribution of revenge pornography or non-consensual intimate images
- Hate speech or incitement to violence
- Copyright infringement at commercial scale
3.5 Service Abuse
- Cryptocurrency mining through the VPN tunnel
- Reselling, sublicensing, or sharing your VPN access
- Attempting to circumvent traffic quotas or device limits
- Reverse engineering, decompiling, or attempting to extract source code
- Torrenting or P2P file sharing on plans that do not explicitly allow it
- Automated scraping or data extraction at excessive volumes
- Using the Service to mask the origin of illegal activities
4. Fair Usage
Each subscription plan includes a monthly traffic allowance. We enforce fair usage to ensure quality service for all users. Excessive bandwidth consumption that degrades service quality for others may result in temporary throttling.
5. Device Limits
Each plan specifies a maximum number of simultaneous device connections. Devices are identified by unique VPN credentials. Sharing credentials or using multiplexing tools to exceed device limits constitutes a violation of this AUP.
6. Abuse Detection & Monitoring
We employ automated systems to detect:
- Abnormal traffic patterns (e.g., DDoS origination, port scanning)
- Excessive concurrent connections from geographically distant locations
- Blacklisted IP behavior reports from third-party abuse databases
- Traffic patterns consistent with malware command-and-control
These systems analyze traffic patterns and metadata only — we do NOT inspect the content of your encrypted traffic.
7. Reporting Abuse
If you become aware of any misuse of our service, please report it through:
- The support ticket system in your dashboard
- Email: abuse@nextunnel.com
We investigate all reports promptly. For reports involving CSAM, terrorism, or imminent threats to life, we cooperate immediately with law enforcement.
8. Enforcement Actions
Violations of this policy may result in the following actions, at our sole discretion:
- Warning: Email notification of the violation with request to cease
- Temporary suspension: 24-72 hour account suspension pending investigation
- Permanent termination: Immediate account closure without refund
- Legal referral: Reporting to appropriate law enforcement authorities
The severity of enforcement depends on the nature and gravity of the violation. Criminal activities (CSAM, terrorism, human trafficking) result in immediate termination and law enforcement referral without prior warning.
9. Appeals
If you believe your account was suspended or terminated in error, you may submit an appeal through our support system. We will review the appeal within 72 hours and provide a final decision.
10. Changes to This Policy
We may update this AUP from time to time. Material changes will be communicated via email. Continued use of the Service after changes take effect constitutes acceptance.
