1. Acceptance of Terms
By accessing, browsing, or using NexTunnel's website, applications, or VPN services (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must immediately cease using the Service.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and the operator of NexTunnel ("NexTunnel," "we," "us," or "our").
2. Definitions
- "Service" — The NexTunnel VPN service, website, APIs, and all associated applications and features.
- "Account" — A registered user account created to access the Service.
- "Subscription" — A paid plan granting access to the VPN service for a specified period.
- "Credentials" — VPN configuration data including VLESS links, QR codes, and UUIDs assigned to your devices.
- "Traffic" — Data transferred through the VPN tunnel, measured in gigabytes (GB).
- "Content" — Any data, information, or material transmitted through the Service.
3. Eligibility & Age Requirements
You must be at least 18 years of age (or the age of legal majority in your jurisdiction, whichever is higher) to use the Service. By creating an Account, you represent and warrant that you meet this age requirement. We reserve the right to request proof of age at any time and to terminate accounts that violate this requirement.
4. Account Registration & Security
To use the Service, you must create an Account by providing accurate and complete information. You are responsible for:
- Maintaining the confidentiality of your Account credentials
- All activities that occur under your Account
- Notifying us immediately of any unauthorized access or security breach
- Ensuring your contact information remains current and accurate
You may not share, sell, transfer, or allow others to use your Account. Each Account is for individual use only. We reserve the right to suspend or terminate accounts with suspicious activity.
5. Service Description
NexTunnel provides a Virtual Private Network (VPN) service using the VLESS+Reality protocol. The Service routes your internet traffic through encrypted tunnels to enhance your privacy and security online. The Service is provided "as is" and "as available."
We do not guarantee that the Service will be uninterrupted, error-free, or that it will meet your specific requirements. Network conditions, server load, and external factors may affect performance.
6. Subscription & Billing
Billing: Subscriptions are billed monthly or annually through Stripe, our payment processor. By subscribing, you authorize recurring charges at the applicable rate for your chosen plan and billing interval.
Price Changes: We reserve the right to modify pricing with at least 30 days' notice. Existing subscribers will be notified before any price change takes effect on their next billing cycle.
Cancellation: You may cancel your Subscription at any time. Cancellation takes effect at the end of your current billing period — you keep full access until then.
Failed Payments: If a payment fails, your account enters a "Past Due" state. You have 7 days to resolve the payment issue before your account is suspended.
7. Trial-First Policy
The 3-day free trial is the verification step. Before subscribing to any paid plan, every prospective customer is offered a 3-day free trial that grants full access to the Service for compatibility testing on their specific network, device, and ISP — no credit card required. The trial exists precisely so you can verify that the Service works for your specific use case before committing to a paid subscription. By the time you choose to pay, you have already confirmed the Service fits your purpose.
Paid subscriptions are final at checkout. Once a paid charge processes, the Subscription runs the full billing period you selected. You may cancel auto-renewal at any time to stop the next billing cycle — you keep full access through the end of the period you have already paid for. NexTunnel does not issue prorated returns or service credits in lieu of credits for the unused portion of an active billing period, because the trial period exists to eliminate that scenario before payment.
By completing checkout you confirm:
- You have read this Section 7 and understand that a paid Subscription runs the full billing period once started
- You either tested the Service via the free trial and confirmed it works on your network, or you voluntarily skipped the trial and accept the resulting risk
- You will not initiate a chargeback or payment dispute for a paid charge after the Service has been delivered
- You acknowledge that VPN effectiveness in censored networks (Iran TCI, Russia СОРМ, China GFW, UAE, etc.) depends on factors outside NexTunnel's control (see Section 7A) and that ineffectiveness in these conditions is not grounds for a chargeback
Cancellation: You may cancel your auto-renewal at any time via the dashboard or by contacting support. Cancellation stops future billing cycles only — your account remains active until the end of the period you have already paid for.
Cryptocurrency payments: Crypto payments are non-reversible on-chain by their nature. Selecting crypto checkout constitutes acknowledgment of this technical irreversibility.
Chargebacks: Initiating a chargeback or payment dispute with your card issuer or bank for a paid NexTunnel subscription, after these Terms have been accepted at checkout and the Service has been delivered, constitutes a material breach of these Terms. Such accounts are immediately and permanently terminated, the disputed amount is contested by NexTunnel using these Terms and the trial-first verification step as evidence, and the customer is added to an industry-shared fraud blocklist that may prevent future signup with NexTunnel and other services that consume the same blocklist.
Repeated billing-dispute requests: Customers who repeatedly contest billing after the trial-first policy has been explained, or who escalate billing demands with threats of public disclosure, defamation, or chargeback, may be treated as engaging in harassment under Section 9 and have their accounts terminated without further notice.
7A. Service Availability & Network Conditions Disclaimer
The Service is provided on a best-effort basis. NexTunnel operates a globally distributed network of VPN servers and continually develops next-generation protocols (Reality, AmneziaWG, Hysteria2, Mieru, NaiveProxy, ShadowTLS, etc.) specifically engineered to resist deep-packet inspection and active network censorship. However, by purchasing or using the Service, you expressly acknowledge and agree that:
- The effectiveness of any VPN service in a given network depends on factors outside our direct control, including but not limited to: government censorship policies, ISP-level traffic shaping or blocking, carrier-grade NAT or firewalls, mobile-network DPI engines (such as those operated by MCI/Hamrah Aval, Irancell/MTN, Rightel, Pars Online, China Mobile / Unicom / Telecom, Roskomnadzor / СОРМ, etc.), domain or IP allowlist regimes, BGP-level routing changes, and active probing by state-level actors
- NexTunnel makes no guarantee, representation, or warranty that any specific server, protocol, or configuration will function on your specific network at any given time. The free trial period exists precisely so you can verify Service compatibility with your network before committing to a paid subscription
- Network conditions change. A configuration that worked yesterday may stop working today due to censor escalation. We respond to such events with countermeasures (alternate ports, rotated SNI fingerprints, new protocols, additional server locations), but we cannot promise an uninterrupted experience in actively censored networks
- Device, operating system, and VPN client application compatibility is the User's responsibility. We publish recommended client lists; using unsupported, outdated, or unofficial clients may result in service failures for which NexTunnel is not liable
- Service ineffectiveness during temporary network events (carrier outages, government-mandated internet shutdowns, BGP hijacks, hosting-provider incidents, third-party DDoS attacks against shared infrastructure) does not constitute a failure of the Service and is not a chargeback-eligible event
- Internal infrastructure incidents that affect Service quality (server downtime, configuration errors, queue backlogs, etc.) are addressed through service credits, complimentary subscription extensions, or other compensatory measures at NexTunnel's sole discretion. The acknowledgment of an internal incident, whether in writing or otherwise, does not automatically entitle the affected customer to a monetary credit beyond such operational remedies
7B. Confidentiality of Support Communications
All communications between you and NexTunnel support — including support tickets, emails, chat transcripts, screenshots provided by support, troubleshooting outputs, internal incident reports shared with you, and any technical or commercial information disclosed in the course of resolving a support case — are confidential and proprietary to NexTunnel.
You agree that you will not, without NexTunnel's prior written consent:
- Publish, post, share, distribute, or otherwise make publicly available the contents of any support communication, in whole or in part, on any social media, public forum, review site, blog, news outlet, video platform, app store review, or other publicly accessible channel
- Disclose support communications to NexTunnel's vendors, hosting providers, payment processors, regulators, or other third parties for the purpose of inducing action against NexTunnel, except where such disclosure is required by binding court order or applicable law and you have given NexTunnel reasonable advance written notice
- Quote, paraphrase, or otherwise reproduce statements made by NexTunnel personnel in support communications in a manner that misrepresents their context, qualifications, or scope
- Use the threat of public disclosure of support communications as leverage to obtain service credits, subscription extensions, or other concessions
Disputes arising from a support case must be raised first through our internal escalation channel at disputes@nextunnel.com. We will respond to good-faith escalations within 5 business days. Public disclosure of support communications in violation of this Section, or threats of such disclosure, constitute a material breach of these Terms and may result in immediate account termination without further service credit, in addition to any remedies NexTunnel may pursue under applicable law.
8. Acceptable Use
Your use of the Service is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference.
9. Prohibited Uses
You may NOT use the Service for any of the following activities:
- Any activity that violates applicable local, national, or international laws or regulations
- Distribution, storage, or transmission of child sexual abuse material (CSAM) — reported to authorities
- Terrorism-related activities, including recruitment, funding, or propaganda
- Human trafficking, exploitation, or forced labor
- Distribution of malware, ransomware, viruses, trojan horses, or other harmful software
- Unauthorized access to computer systems, networks, or data (hacking)
- Distributed Denial of Service (DDoS) attacks or participation in botnets
- Fraud, phishing, identity theft, or social engineering attacks
- Sending spam, unsolicited bulk communications, or commercial solicitation
- Harassment, threats, stalking, doxxing, or intimidation of individuals
- Copyright infringement at commercial scale
- Cryptocurrency mining through the VPN tunnel
- IP address spoofing or network manipulation beyond the VPN's intended function
- Reselling, sublicensing, or sharing your VPN access with third parties
- Attempting to circumvent traffic quotas, device limits, or other Service restrictions
- Scraping, data mining, or automated access to websites in violation of their terms
- Torrenting or P2P file sharing on plans that do not explicitly allow it
10. Traffic Quotas & Fair Usage
Each Subscription plan includes a monthly traffic allowance. Traffic usage is calculated based on the total data transferred through the VPN tunnel. When you reach your limit, you may purchase additional traffic or wait for your next billing cycle. We reserve the right to throttle connections that exhibit abnormal usage patterns to protect service quality for all users.
11. Device Limits
Each plan specifies a maximum number of simultaneous device connections. Attempting to exceed or bypass device limits (including using VPN multiplexing or sharing) may result in account suspension.
12. Intellectual Property
All intellectual property rights in the Service, including but not limited to the website, software, documentation, logos, and trademarks, are owned by NexTunnel or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose during your active Subscription.
13. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- NexTunnel provides the Service "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or successful circumvention of any specific censorship regime
- We do not warrant that the Service will be uninterrupted, secure, error-free, or capable of bypassing any specific firewall, DPI engine, or government-mandated network restriction
- We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to lost profits, lost savings, lost data, lost productivity, or lost business opportunities — even if NexTunnel has been advised of the possibility of such damages
- Our total aggregate liability for any and all claims arising from or related to the Service, regardless of the form of action, shall not exceed the lesser of (a) the amount you paid to NexTunnel in the three (3) months immediately preceding the claim or (b) USD $100
- We are not responsible for any content transmitted through the VPN tunnel by any User
- We are not liable for actions taken by third parties, including but not limited to ISPs, mobile carriers, hosting providers, payment processors, government entities, regulatory bodies, or law-enforcement agencies
- We are not liable for service ineffectiveness caused by: government censorship policies (active or passive), ISP-level traffic shaping, carrier-level DPI, mobile-network firewalls, deliberate Internet shutdowns, BGP route changes, hosting-provider incidents, third-party DDoS attacks, IPv6 misconfiguration on the User's side, captive portals, corporate network restrictions, or User-side device, OS, or application defects
- The acknowledgment by NexTunnel personnel of an internal infrastructure issue, whether in writing or verbally, does not constitute an admission of legal liability or a waiver of the limitations set forth in these Terms — internal incidents are resolved through service credits, subscription extensions, or other operational remedies at our sole discretion
- This Section 14 shall survive termination or expiration of these Terms
14A. Force Majeure
NexTunnel shall not be liable for any failure or delay in the performance of its obligations under these Terms to the extent such failure or delay is caused by events beyond NexTunnel's reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, civil unrest, government actions, embargoes, government-mandated internet shutdowns, BGP-level routing attacks against shared infrastructure, hostile DDoS campaigns by state-level actors, hosting-provider outages, payment-processor outages, third-party API failures, and pandemic-related disruptions. Force majeure events do not entitle the User to a chargeback; service-credit extensions may be granted at NexTunnel's sole discretion.
15. Indemnification
You agree to indemnify, defend, and hold harmless NexTunnel, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any content transmitted through the Service via your Account
- Any illegal activity conducted through your Account
- Your unauthorized public disclosure of confidential support communications in violation of Section 7B
- Any chargeback, payment dispute, or fraud claim filed by you against NexTunnel that is determined to be unfounded under Section 15A
15A. Chargebacks & Payment Disputes
Filing a chargeback, dispute, fraud claim, or reversal request with your bank, card issuer, payment processor, or cryptocurrency exchange against a charge from NexTunnel is a serious matter and is subject to the following rules:
- Mandatory pre-dispute contact. You must contact NexTunnel support at support@nextunnel.com and allow us at least 5 business days to investigate and respond before initiating any chargeback or dispute. Disputes filed without first contacting us constitute bad-faith disputes and may be challenged accordingly
- Account suspension on dispute. When a chargeback or dispute is opened against an active subscription, we reserve the right to immediately suspend the associated Account, revoke all VPN credentials, and withdraw any service-credit, extension, or compensation previously granted. Suspension does not constitute admission of dispute validity
- Bad-faith disputes. Filing a chargeback for a charge that is determined by the payment processor to be valid (i.e. you received the Service you paid for) constitutes a material breach of these Terms. Consequences include permanent ban from the Service, blocking of future signups using the same payment method or any device fingerprint reasonably linked to your Account, and recovery of fees, charges, and reasonable attorney's fees incurred by NexTunnel in defending the dispute
- Cryptocurrency disputes. Cryptocurrency transactions are settled on-chain and are not reversible. Filing a fraud or scam complaint with a cryptocurrency exchange, wallet provider, or blockchain investigator regarding a NexTunnel charge — without first attempting good-faith resolution through disputes@nextunnel.com — is a violation of these Terms and may be reported to the relevant exchange's compliance team with supporting documentation
- Hosting / network provider complaints. Filing a complaint, abuse report, or compliance request with NexTunnel's hosting providers, payment processors, domain registrars, DNS providers, or other vendors regarding a contractual support disagreement (i.e. when you should be contacting NexTunnel support directly) is bad-faith conduct, breaches these Terms, and may result in legal recovery of any commercial damages or service-disruption costs caused thereby
15B. Acknowledgment at Checkout
By completing the checkout process for any NexTunnel Subscription — whether by credit card, cryptocurrency, or any other payment method we offer — you affirm and acknowledge that you have read, understood, and accepted these Terms in full, including without limitation: Section 7 (Trial-First Policy), Section 7A (Service Availability Disclaimer), Section 7B (Confidentiality of Support Communications), Section 14 (Limitation of Liability), Section 14A (Force Majeure), Section 15 (Indemnification), and Section 15A (Chargebacks & Payment Disputes). The free 3-day trial period exists specifically so you can verify Service compatibility with your network before committing to a paid Subscription. Proceeding to checkout means you have either completed the trial period to your satisfaction, or you have voluntarily waived your opportunity to test the Service in advance and accept the resulting risk.
16. Cooperation with Law Enforcement
NexTunnel operates in full compliance with applicable laws and regulations. We cooperate with law enforcement authorities when presented with valid legal process, including court orders, warrants, subpoenas, or official requests from competent authorities.
Due to the technical architecture of our service and our strict no-browsing-logs policy, the information we can provide is limited to:
- Account registration data (name, email, registration date, registration IP)
- Payment records (transaction dates, amounts, payment method)
- Connection metadata (connection timestamps, duration, server used, protocol, bytes transferred)
- Login history (IP addresses used to access the account)
We do NOT have the ability to provide browsing history, visited URLs, DNS queries, or the content of internet traffic. The VLESS+Reality encryption protocol prevents us from inspecting tunnel content.
In cases involving child sexual abuse material (CSAM), terrorism, human trafficking, or imminent threats to life, we will cooperate fully, promptly, and proactively with relevant authorities, including voluntary disclosure where legally permitted.
Abuse Reporting: To report abuse originating from our network, contact abuse@nextunnel.com with relevant evidence including timestamps and IP addresses.
17. Termination & Suspension
We may suspend or terminate your Account immediately, without prior notice, if:
- You violate these Terms or the Acceptable Use Policy
- Your use of the Service poses a security risk or may cause harm to other users
- We are required to do so by law
- Your payment obligations are not met
Upon termination for violations, you are not entitled to any service credit or remaining-period extension. We reserve the right to report illegal activities to the appropriate authorities.
18. Modifications to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on our website at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the modified Terms.
19. GDPR & Data Protection
If you are located in the European Economic Area (EEA), you have rights under the General Data Protection Regulation (GDPR). Please refer to our Privacy Policy for details on data processing, legal bases, and your rights.
20. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Romania and the European Union. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Romania, unless mandatory consumer protection laws in your jurisdiction provide otherwise.
21. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
22. Entire Agreement
These Terms, together with the Privacy Policy, Acceptable Use Policy, and Cookie Policy, constitute the entire agreement between you and NexTunnel regarding the Service, superseding any prior agreements.
